KLAUZULA INFORMACYJNA 
dotycząca przetwarzania danych osobowych kontrahentów, osób upoważnionych do reprezentacji kontrahentów, osób kontaktowych ze strony kontrahentów oraz artystów
 
Zgodnie z obowiązkiem wynikającym z rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dn. 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (RODO), informujemy, że: 
1. Administratorem Państwa danych osobowych jest Muzeum Sztuki Nowoczesnej w Warszawie, adres: ul. Pańska 3, 00-124 Warszawa, wpisane do rejestru instytucji kultury Miasta Stołecznego Warszawy pod nr RIK/1/2023, REGON: 140187435, NIP: 525-234-18-32 (dalej również „Administrator” lub „Muzeum”). W sprawach dotyczących ochrony danych osobowych można kontaktować się z Muzeum:
a) listownie: na adres siedziby Muzeum,
b) e-mail: iod@artmuseum.pl.
2. Administrator danych wyznaczył Inspektora Ochrony Danych, z którym można się kontaktować drogą mailową pod adresem: iod@artmuseum.pl.
3. Dane osobowe są przetwarzane:
a) w przypadku kontrahentów Muzeum, w tym osób posiadających prawa do rozporządzania utworem lub utworami – w celu nawiązania i wykonania umowy, której są stroną; w takim przypadku podstawą przetwarzania danych osobowych jest art. 6 ust. 1 lit. b) RODO, 
b) w przypadku pracowników, współpracowników kontrahenta Muzeum oraz osób upoważnionych do reprezentacji kontrahenta Muzeum, w tym kontrahentów posiadających prawa do rozporządzania utworem lub utworami – w celu zawarcia i/ lub wykonania umowy; w takim przypadku podstawą przetwarzania danych osobowych jest art. 6 ust. 1 lit. f) RODO, natomiast zawarcie i wykonanie umowy stanowi prawnie uzasadniony interes Muzeum jako administratora danych, 
c) w przypadku twórców dzieła będącego przedmiotem umowy – w celu realizacji prawa twórcy do oznaczenia dzieła; w takim przypadku podstawą przetwarzania danych jest art. 6 ust. 1 lit. f) RODO, natomiast obowiązek oznaczenia dzieła stanowi prawnie uzasadniony interes Muzeum jako administratora danych. 
4. Dane osobowe mogą być przetwarzane również na podstawie:
a) art. 6 ust. 1 lit. f) RODO, tj. w sytuacji, gdy przetwarzanie jest niezbędne do celów wynikających z prawnie uzasadnionych interesów realizowanych przez Administratora lub przez stronę trzecią, takich jak ustalanie, dochodzenie lub obrona roszczeń w związku z zawarciem i wykonywaniem umowy zawartej przez Muzeum z kontrahentem lub osobą posiadają prawa do rozporządzania utworem lub utworami, 
b) art. 6 ust. 1 lit. c) RODO, tj. w sytuacji, gdy przetwarzanie jest niezbędne do wypełnienia obowiązku prawnego ciążącego na Administratorze, w tym w zakresie obowiązków archiwizacyjnych dotyczących przechowywania dokumentów dla celów podatkowych, archiwizacji dokumentacji dotyczącej zawarcia i wykonywania umowy na podstawie przepisów o narodowym zasobie archiwalnym i archiwach, 
c) art. 6 ust. 1 lit. a) RODO, jeśli udzielili Państwo zgody na przetwarzanie określonych kategorii danych osobowych w określonym celu; może do dotyczyć w szczególności przetwarzania danych osobowych w postaci wizerunku w związku z dokumentowaniem wydarzenia w postaci zdjęć i/lub nagrań video lub audio-video. 
5. Muzeum przetwarza dane zwykłe obejmujące w szczególności:
a) w przypadku osób fizycznych, z którymi zawiera umowę: imię, nazwisko, adres zamieszkania, PESEL a w przypadku osób prowadzących działalność gospodarczą: nazwa firmy, adres prowadzenia działalności, NIP, REGON, dane kontaktowe (w tym adres e-mail, nr telefonu), 
b) w przypadku pracowników, współpracowników kontrahenta Muzeum oraz osób upoważnionych do reprezentacji kontrahenta Muzeum, w tym kontrahentów posiadających prawa do rozporządzania utworem lub utworami: imię, nazwisko, stanowisko służbowe, dane dotyczące pracodawcy/zleceniodawcy, służbowe dane kontaktowe (adres e-mail, nr telefonu), 
c) w przypadku twórców: imię i nazwisko, pseudonim.
6. Muzeum pozyskuje dane osobowe co do zasady bezpośrednio od osób, których dane dotyczą. W przypadku pracowników i współpracowników kontrahentów, w tym osób posiadających prawa do rozporządzania utworem lub utworami oraz twórców dzieł (jeśli nie są stroną umowy) – dane osobowe są pozyskiwane od kontrahenta. Część danych osobowych może być także pozyskiwana ze źródeł publicznych (publicznie dostępne rejestry, jak CEIDG, KRS). 
7. Podanie danych osobowych jest dobrowolne, ale niezbędne do zawarcia i wykonywania umowy zawartej przez Muzeum i kontrahenta, a w przypadku twórców – do oznaczenia dzieła. Konsekwencją niepodania danych może być brak możliwości zawarcia i wykonywania umowy, a w przypadku odmowy podania danych przez twórcę – udostępnienie dzieła anonimowo. W przypadku przetwarzania danych na podstawie udzielonej zgody, co do zasady nie są przewidziane konsekwencje związane z niepodaniem danych.
8. Odbiorcami Państwa danych osobowych mogą być: podmioty świadczące usługi hostingowe poczty elektronicznej i inni dostawcy usług IT, kontrahenci Muzeum, którym zleciło ono realizację całości lub części usług w związku z wykonywaniem zawartej umowy o dzieło, podmioty świadczące usługi księgowe, audytorskie lub doradcze, w tym prawne oraz podatkowe, Szef Krajowej Administracji Skarbowej w związku z wystawianiem faktur ustrukturyzowanych w KSeF. Państwa dane osobowe mogą być także udostępnione w trybie dostępu do informacji publicznej (o ile warunki zawarcia umowy mogą stanowić informację publiczną w rozumieniu przepisów o dostępie do informacji publicznej), a ponadto dane osobowe kontrahentów będących osobami fizycznymi mogą być udostępnione nieograniczonemu kręgowi adresatów za pośrednictwem sieci Internet poprzez Centralny Rejestr Umów m.st. Warszawy. W związku z możliwością upublicznienia informacji o osobie lub wizerunku, jego odbiorcami mogą być także dostawcy serwisów społecznościowych, w których Muzeum prowadzi swoje social media (Facebook, Instagram, LinkedIn, X), osoby odwiedzające strony internetowe, na których dostępne będą przygotowane materiały, w tym strona internetowa Muzeum oraz social media prowadzone Muzeum, odbiorcy innych materiałów.
9. Państwa dane osobowe będą przetwarzane przez Muzeum przez czas trwania umowy, a także mogą być przetwarzane później, tj. przez czas niezbędny do dochodzenia lub obrony przed roszczeniami zgodnie z właściwymi przepisami prawa (to jest 3 lata), związku z koniecznością wypełnienia obowiązków prawnych ciążących na Muzeum jako administratorze, w szczególności obowiązku archiwizacyjnego dotyczącego dokumentów przechowywanych w celach podatkowych i rachunkowych (to jest przez okres 5 lat od końca roku, w którym zapłacono podatek), w zależności od tego, który okres będzie dłuższy. Przepisy odrębne mogą także przewidywać dłuższy termin przechowywania dokumentów, w tym danych osobowych, dla wybranych kategorii spraw. Może to dotyczyć w szczególności dokumentacji o znaczeniu archiwalnym, gdzie dane mogą być przechowywane przez dłuższy okres w interesie publicznym zgodnie z przepisami o archiwizacji. Przetwarzanie to odbywa się zgodnie z obowiązującą w Muzeum klasyfikacją dokumentów, to jest co do zasady przed okres 25 lat, a w ściśle określonych przypadkach wieczyście. 
10. Posiadają Państwo prawo do: żądania dostępu do przekazanych danych osobowych, sprostowania danych osobowych, żądania usunięcia danych osobowych, a także ograniczenia przetwarzania danych osobowych.
11. Jeśli Państwa dane są przetwarzane na podstawie pkt 3 lit. a) lub 4 lit. c) powyżej, posiadają Państwo również prawo do przenoszenia danych osobowych, pod warunkiem że przetwarzanie odbywa się w sposób zautomatyzowany.
12. Jeśli Państwa dane osobowe są przetwarzane na podstawie pkt 3 lit. b)-c) lub pkt 4 lit. a) powyżej, posiadają Państwo także prawo do wniesienia sprzeciwu wobec przetwarzania danych osobowych w związku z Państwa szczególną sytuacją. 
13. Jeśli Państwa dane są przetwarzane na podstawie pkt 4 lit. c) powyżej, posiadają Państwo także prawo do wycofania zgody w dowolnym momencie, bez wpływu na zgodność z prawem przetwarzania, którego dokonano przez jej wycofaniem. 
14. Ponadto posiadają Państwo prawo do wniesienia skargi do właściwego organu nadzorczego, którym w Polsce jest Prezes Urzędu Ochrony Danych Osobowych.
15. W stosunku do przekazanych danych osobowych decyzje nie będą podejmowane w sposób zautomatyzowany, w tym w oparciu o profilowanie. 
W przypadku publikacji materiałów zawierających informacje o osobie lub wizerunek w serwisach społecznościowych (Facebook, Instagram, LinkedIn, X) dane osobowe mogą być przekazane do USA. Odbywa się to na podstawie decyzji wykonawczej Komisji Europejskiej stwierdzającej odpowiedni stopień ochrony (EU-US Data Privacy Framework).  
INFORMATION CLAUSE 
concerning the processing of personal data of contractors, persons authorized to represent contractors contact persons of contractors and artists
 
Pursuant to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) we inform that:
1. Muzeum Sztuki Nowoczesnej w Warszawie (Museum of Modern Art in Warsaw), address: ul. Pańska 3, post code: 00-124 Warsaw, Poland, entered into the register of cultural institutions of the Capital City of Warsaw under the number: RIK/1/2023, REGON (statistical number): 140187435, NIP (tax identification number): 525-234-18-32 is the controller of your personal data (hereinafter referred to as the “Controller” or the “Museum”). In matters relating to the protection of personal data, you can contact the Museum:
a) by post: to the address of the registered office of the Museum,
b) by e-mail: iod@artmuseum.pl. 
2. The Controller has appointed a Data Protection Officer (DPO) and you can contact the DPO by e-mail at: iod@artmuseum.pl.
3. Your personal data is processed:
a) if you are contractors of the Museum or the persons holding the rights to dispose of a work or works – for the purpose of concluding and performing a contract to which you are a party; in this case, the legal basis for data processing is Article 6(1)(b) of the GDPR, or
b) in the case of employees, collaborators of the Museum's contractor and persons authorized to represent the Museum's contractor, including contractors who have the rights to dispose of the work or works, and your data has been made available by your employer, principal or directly by you – in order to conclude and perform the contract concluded between the Museum and your employer or principal; in this case, the basis for data processing is Article 6(1)(f) of the GDPR, while the conclusion and performance of the above-mentioned contract constitutes the legitimate interest of the Museum as the data controller,
c) in the case of creator of the work being the subject of the contract – in order to exercise the creator's right to mark the work; in this case, the basis for data processing is Article 6(1)(f) of the GDPR, while the obligation to mark the work is the legitimate interest of the Museum as the data controller.
4. Your personal data may also be processed on the basis of:
a) Article 6(1)(f) of the GDPR, i.e. when processing is necessary for the purposes of the legitimate interests pursued by the Museum or a third party, such as establishment, exercise or defence of legal claims in connection with the performance of the contract concluded between the Museum and the contractor or a person who has the right to dispose of a work or works,
b) Article 6(1)(c) of the GDPR, i.e. when processing is necessary to comply with a legal obligation incumbent on the Controller, including archiving obligations regarding the storage of documents for tax purposes, archiving documentation relating to the conclusion and performance of a contract under the provisions on national archival resources and archives,
c) Article 6(1)(a) of the GDPR, if you have consented to the processing of certain categories of personal data for a specific purpose; this may apply, in particular, to the processing of personal data in the form of an image in connection with documenting an event in the form of photographs and/or video or audio-video recordings.
5. The Museum processes ordinary data, including in particular:
a) in the case of contractors: name, surname, company name, business address, NIP (tax identification number), REGON (statistical number), contact details (including email address, telephone number),
b) in the case of employees/co-workers of contractors and persons authorized to represent contractors: name, surname, job position, details of the employer/client, business contact details (e-mail address, telephone number),
c) in the case of creators – name, surname, pseudonym.
6. The Museum obtains personal data, as a rule, directly from the data subjects. In the case of employees and co-workers of contractors, including persons with the rights to dispose of the work or works and creators of works (if they are not a party to the contract) – personal data may also be obtained from the contractor. Some personal data may also be obtained from public sources (publicly available registers, such as CEIDG /Central Register and Information on Business/, KRS /National Court Registers/).
7. Providing personal data is voluntary, but necessary to conclude and perform the contract concluded by the Museum and the contractor, and in the case of creators – to  mark the work. The consequence of not providing data may be the inability to conclude and perform the contract, and in the event of the creator's refusal to provide data – making the work available anonymously. In the case of data processing based on consent, as a rule there are no consequences for failure to provide data.
8. Recipients of your personal data may include: entities providing email hosting services and other IT service providers, contractors of the Museum commissioned to perform all or part of the services in connection with the performance of a concluded contract for specific work, entities providing accounting, auditing, or advisory services, including legal and tax services, Head of the National Tax Administration in connection with issuing structured invoices in the National e-Invoicing System (KSeF). Your personal data may also be made available under the public information procedure (provided that the terms of the contract may constitute public information within the meaning of the regulations on access to public information). Furthermore, the personal data of contractors who are natural persons may be made available to an unlimited number of recipients via the Internet through the Central Register of Contracts of the Capital City of Warsaw. Due to the possibility of publishing information about a person or image, recipients may also include providers of social networking sites where the Museum operates its social media (Facebook, Instagram, LinkedIn, X), visitors to websites where prepared materials will be available, including the Museum's website and social media operated by the Museum, and recipients of other materials.
9. Your personal data will be processed by the Museum for the duration of the contract and may also be processed thereafter, i.e., for the time necessary to pursue or defend against claims in accordance with applicable law (i.e., 3 years), in connection with the need to fulfill the legal obligations incumbent on the Museum as a controller, in particular the archiving obligation regarding documents stored for tax and accounting purposes (i.e., for a period of 5 years from the end of the year in which tax was paid), whichever is longer. Separate regulations may also provide for a longer period of document storage, including personal data, for selected categories of cases. This may apply, in particular, to documentation of archival importance, where data may be stored for a longer period in the public interest in accordance with archiving regulations. This processing is carried out in accordance with the document classification applicable at the Museum, which is generally for a period of 25 years, and in strictly defined cases, perpetually.
10. You have the right to request access to your personal data, rectification of your personal data, erasure of your personal data or restriction of processing your personal data.
11. If your personal data is processed under point 3(a) or point 4(c) above, you also have the right to data portability, provided that the processing of personal data is carried out by automated means.
12. If your personal data is processed under point 3(b)-(c) or point 4(a) above, you also have the right to object to processing your personal data on grounds relating to your particular situation.
13. If your personal data is processed under point 4(c) above, you also have the right to withdraw your consent at any time, without affecting the lawfulness of processing carried out prior to your withdrawal.
14. Furthermore, you have the right to lodge a complaint with a supervisory authority – in Poland it’s: the President of the Data Protection Office. 
15. There shall be no automated decision-making, including profiling, as regards to your personal data.
When publishing materials containing personal information or image on social media (Facebook, Instagram, LinkedIn, X), personal data may be transferred to the USA. This is done based on the European Commission's implementing decision establishing an adequate level of protection (EU-US Data Privacy Framework).
